EVH Ateliér s.r.o. (Atelièr Pryimak)

1. Introductory provisions
These Terms and Conditions ("Terms and Conditions") of EVH Ateliér s.r.o., company registration number: 23272503,
with registered office at Tatranská 860/7, 460 07 Liberec, Czech Republic (hereinafter "Seller"), govern,
in accordance with Section 1751 of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations
of the contracting parties arising in connection with a purchase contract concluded between the Seller and
the buyer (hereinafter "Buyer").
These Terms and Conditions apply to purchases made through the Seller's online shop
operated at the web address:
www.atelierpryimak.cz
The Buyer may be a natural or legal person. A consumer is a Buyer who is a natural person
and who, when concluding a contract, does not act in the course of their business activity.
The purchase contract and these Terms and Conditions are drawn up in the Czech language.
The Seller reserves the right to amend or supplement these Terms and Conditions to a reasonable extent. This does not affect
rights and obligations that arose during the period of validity of the previous version.

2. Conclusion of the purchase contract

The presentation of goods in the online shop is for information purposes only and does not constitute a binding
offer to conclude a contract.
An order placed by the Buyer through the online shop constitutes a proposal to conclude a purchase
contract.
The purchase contract is concluded upon confirmation of the order by the Seller, typically
by e-mail.
The Seller reserves the right to decline an order in particular in cases where:
● an obvious error in the price or product description has occurred
● the goods are no longer available
● the Buyer has previously breached their obligations towards the Seller.

3. Types of sale and order fulfilment

The Seller offers in particular the following forms of sale:
Ready-made timepieces
The Buyer pays 100% of the purchase price and the timepiece is subsequently dispatched or handed over.
Bespoke commissions
The Buyer pays a deposit of 30% of the total price. Upon completion of the project, the Seller issues
a final invoice for the outstanding balance.
Project pre-order
For certain projects, 100% payment in advance may be required. The project completion date is
always stated in the product description.
In individual cases, the parties may agree on a deposit of 30% with the balance payable upon
completion of the project.

4. Payment terms

Prices are quoted in Czech crowns (CZK). The Seller is not registered for VAT.
Payments are made by bank transfer to the account:

Upon completion of a bespoke project, the Seller will issue a final invoice for the outstanding balance.
The Buyer is required to settle the balance within 30 days of the date of the final invoice.
If the Buyer fails to pay the balance within this period, this constitutes a material breach of
contract.
In such a case:
● the Seller is entitled to withdraw from the contract
● the deposit paid of 30% is forfeited in favour of the Seller as a contractual penalty
and as compensation for the costs incurred in carrying out the project
● the Seller is entitled to offer or sell the timepiece to another customer.

5. Delivery timescales

The delivery date is stated on the relevant product page or in the order confirmation.
For bespoke commissions, the delivery date may be reasonably extended in particular owing to:
● hand craftsmanship
● restoration work
● the technical complexity of the project
● the availability of historical components
● the lead times of subcontractors.
The Buyer acknowledges that the majority of Atelièr Pryimak projects are carried out by hand craftsmanship and
restoration methods.


6. Delivery and shipping

The Seller dispatches goods primarily to:
● the Czech Republic
● Slovakia
● countries of the European Union
Delivery to other countries is available by individual arrangement.
The risk of damage to the goods passes to the Buyer at the moment of receipt.
The Buyer is required to inspect the condition of the parcel upon receipt and to notify the carrier without delay of any damage.

7. Consumer's right of withdrawal

A consumer has the right to withdraw from a distance contract within 14 days of receiving the goods, without
giving any reason.
This right does not apply to goods manufactured to order or modified in accordance with the individual
requirements of the Buyer.
In the event of withdrawal, the Buyer bears the cost of returning the goods.
The Seller will refund all payments received from the Buyer within 14 days of withdrawal at the latest,
but not before receiving the returned goods.

8. Warranty and complaints

The Seller provides a 12-month warranty on timepieces fitted with a historical movement.
The Seller provides a 24-month warranty on timepieces fitted with a modern Swiss movement.
The warranty covers defects arising during normal use.
The warranty does not cover in particular:
● damage caused by water or moisture
● mechanical damage (dropping, impact)
● chemical damage
● unauthorised interventions
● normal wear and tear.

9. Particulars of vintage timepieces

The Buyer acknowledges that some timepieces may contain historical movements and components.
With vintage timepieces it is common that:
● the movement's sound may be more audible
● accuracy may differ from that of modern quartz or modern mechanical
timepieces
● the design and construction corresponds to the period in which the movement was made.
The Seller services, tests, and regulates every timepiece before dispatch.

10. Authenticity of historical components

The Seller guarantees the authenticity of historical movements and components on the basis of the many years of
experience and professional expertise of Atelièr Pryimak.
The atelier does not as a rule issue formal third-party authentication certificates.
Upon request, the Seller may provide photographic documentation of the movement or components used.

11. Out-of-court dispute resolution

The Czech Trade Inspection Authority is competent for the out-of-court resolution of consumer disputes.

12. Protection of personal data

The Seller processes the Buyer's personal data in accordance with the laws of the Czech Republic
and the GDPR.

These Terms and Conditions enter into force on 4 March 2026.
